Annual Holiday Rules

In Lyons v Mitie Security Ltd, the EAT held that a worker who fails to comply with statutory or contractual notice requirements for taking holiday can lose annual leave at the end of the leave year if not taken.

In other words, if an employee is required under their contract to give 28 days’ notice of intended holiday but leaves it until he/she can only give, say, 14 days before the end of the holiday year then they lose the right to take the leave.
