The Equal Pay Act 1970 applies to both men and women, there is no specific right under the Act for a person to claim equal pay or other terms of employment by simply comparing with a person of the same sex.
Defence to an equal pay claim: Under the Equal Pay Act 1970, an employer may have defence to an equal pay claim-whether made under the like work, work rated as equivalent or equal value provisions-if he can prove that the variation/inequality in pay is genuinely due to a material factor that is not the difference in sex.
